The Option of Meeting Place

Abstract

Among the ten options mentioned in the Iranian civil code, the first, in terms of nominal sequence, is the option of Majlis (meeting place), which is “the option in which, after the conclusion of the contract of sale, each of the parties (seller or purchaser) would hold the right to void it before separating”. This option, in the ‘al-Sonnah of Foqaha’ (the words, hearsay, or the methodology of religious sciences’ scholars) is referred to as the ‘option of meeting place’. The current study is aimed at investigation of the option of meeting place, its boundaries, and the causes of its rescission.
